The Rape Of The Seychelles Constitution

Ramkalawan's proposed Constitutional misdeeds will forcibly violate the Seychelles Constitution. In a one‐ person constitutional crisis, the man is 'one lab accident’ away from becoming a supervillain. Our country will suffer consequences if we allow arrogant and vindictive politicians to go to an unprecedented level of shameless, flagrant actions and dictator‐ ship. We refer to their proposed CONSTITUTION OF THE REPUBLIC OF SEYCHELLES (TENTH AMEND‐ MENT) BILL, 2022, relevant to the Defense Forces and the ANTI‐ CORRUPTION (AMENDMENT) BILL, 2022.

This totalitarian leadership wants to control all aspects of the public and private lives of the people violating human rights, denying freedoms, and taking revenge. Ramkalawan's ongoing attempts to rape the sacred book of our country will give the entire defense forces power to do all the functions of the Police Force, including civilian arrest. As president and commander‐in‐chief, he can enforce his autocratic rule. 



The second proposed amendment will effectively affect a citizen's Fair Hearing Rights (19.4), implying that the law is not retrospective. The government cannot flex the powers of the ACCS for it to deal with past events or situations so that it can exact political revenge. The president betrays the people's trust because he is not acting in good faith, fairly, and reasonably in this act of revenge. The Constitution states that a person shall not be guilty of an offense on account of any act or omission that did not constitute an offense at the time it took place. Except for genocide or a crime against humanity. The proposed amendments give the ACCS powers to investigate and prose‐ cute conspiracy violations and at‐ tempts and offenses of money laundering committed before enacting the Anti‐Money Laundering and Countering the Financing of Terrorism Act 2020. The Bill also proposes extending to the Commission asset recovery powers following a conviction for offenses committed to enacting the Anti‐ Money Laundering and Countering the Financing of Terrorism Act, 2020. 

These dangerous and wicked amendments aim to give Ramkalawan the power to be judge and jury in political fights with his opponents dated twenty years ago.

These amendments also put the ACCS on equal footing with the Attorney General's office to investigate and prosecute, which is unacceptable and inappropriate. It is arrogant, condescending, and disrespectful. 

Politicians in government are mocking and violating the Constitution they swore to uphold to penalize citizens, take away their rights, and get revenge on their political opponents. When this happens, the Seychellois people have no assurance that their president makes decisions based on their best interests rather than on personal interests.

No one not even the president is above the law, but a unified effort to stop the rape is also for the survival of our constitutional democracy. The presidential oath of office demands that the president preserve, protect and defend the Constitution of Seychelles and not use it to become a modern‐day dictator. His attempts to use the armed forces and ACCS threaten to disrupt the norms of a free and decent society and the stability of our peace‐loving nation.

A provision of the Constitution disregarded and disobeyed without consequence places the lasting protection of our rights and liberties at risk. Every wicked legislation from the National Assembly weakens the Constitution's ability to protect the Seychellois people from violation and possible lawless behavior from the State House. The Constitution does not make the president a king. The Constitution is not his diary. Independent institutions should take him or ACCS to court and demand that the court act expeditiously to help protect the Seychelles democracy. They have already mocked the court case found illegal against 6 Seychellois they have kept in jail for five months. Ramkalawan commands a bunch of cowards in the National Assembly who cannot take their government to task. Therefore, we do not expect them to have a conscience to preserve the Constitution and hold the government officials responsible for adhering to it. Our Constitution is a national symbol, a sacred book or sacred emblem of liberty, unity, and democracy. If we do not stand up to defend it will become a worthless piece of paper. As a people, we will lose all our rights guaranteed to us.
